Reminder: Deadline for Tier 1 (General Visa) Indefinite Leave To Remain Applications

If you are hoping to make an application for indefinite leave to remain under Tier 1 General Visa, please be warned that this application route will close on 5th April 2018. It’s important that you make your application on or before this date in order to be eligible. You will also need to make sure you have completed the English Language Assessment part of your application in good time.

The Tier 1 General Visa route has been closed for some years, but those already on the visa were granted an extension to be able to apply for ILR. This deadline is now fast approaching, so if you are eligible for ILR and want to remain in the UK, you should make you application soon. If you miss the deadline, you may have to leave the UK or apply under a different visa category.

Why was Tier 1 General Visa Ended?

In 2015, the Home Office announced the end to the Tier 1 General Visa route in order to reduce immigration to the 100,000 target. Previously, highly skilled individuals could apply for the Tier 1 General Visa which lasted for 2 years and then apply for a 3-year extension. After this, they would be eligible to apply for Indefinite Leave to Remain, if they met all of the other requirements. As it has now been 3 years since the Tier 1 General Visa was phased out, these visa renewals will now be coming to an end and the holders will have to apply for a new category of leave the UK.

Am I eligible for ILR?

To be eligible for indefinite leave to remain, you must meet the following criteria:

  • Be aged 18-64
  • Meet the earnings threshold for 12 months of the last 15 months
  • Pass the life in the UK test
  • Meet the English language requirements

What are my options otherwise?

If you don’t want to apply for indefinite leave to remain, or you are ineligible, you will need to leave the UK or apply in a different visa category. Some people may be ineligible because they have been outside the UK too much. Others will fail to meet the earnings threshold.
